Terms of Use

Welcome to PictoPress. PictoPress is a product of Specialty Medical Response and Transportation, LLC ("SMRT," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the PictoPress platform, including our website, web application, APIs, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf. If you are using PictoPress on behalf of an organization, school, or other entity, you represent that you have authority to bind that entity to these Terms.

2. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect any unauthorized use of your account.

3. Description of Service

PictoPress is a cloud-based picture book creation platform that allows users to design, save, and publish illustrated books. We offer a free tier and paid subscription plans — including a Premium plan and an Education plan for schools and organizations — each with different feature sets.

4. Subscription Plans and Billing

Paid plans are billed on a recurring monthly basis via our third-party payment processor, Stripe. By subscribing to a paid plan, you authorize SMRT to charge your payment method on a recurring basis until you cancel. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.

The Education plan is custom-priced starting at $49/month and requires prior approval from SMRT. Access to the Education portal is granted only after a formal agreement is in place. Organizations interested in the Education plan should contact us at pictopress.com/contact to begin the onboarding process.

5. User Content

You retain all ownership rights in content you create using PictoPress ("User Content"). By submitting User Content to the Service, you grant SMRT a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your User Content solely as necessary to provide and improve the Service. By publishing content to the Community Library, you make that content publicly accessible to all users of the Service.

You are solely responsible for your User Content. You agree not to upload or publish content that:

  • Infringes any copyright, trademark, or other intellectual property right;
  • Contains unlawful, harmful, threatening, abusive, or defamatory material;
  • Exploits or harms minors in any way;
  • Impersonates any person or entity; or
  • Contains malicious code or attempts to interfere with the platform.

6. Community Library

When you publish a book to the PictoPress Community Library, it becomes publicly viewable by all users. You may unpublish your content at any time from your dashboard. SMRT reserves the right to remove any published content that violates these Terms without prior notice.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • Attempt to gain unauthorized access to any portion of the Service or its related systems;
  • Reverse engineer, decompile, or disassemble any part of the Service;
  • Use automated means (bots, scrapers) to access the Service without our prior written consent; or
  • Interfere with or disrupt the integrity or performance of the Service.

8. Intellectual Property

The Service, including all software, design, text, graphics, logos, and other content created by SMRT, is owned by or licensed to Specialty Medical Response and Transportation, LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written permission.

9. Third-Party Services

The Service integrates with third-party services, including Stripe for payment processing and Remove.bg for AI-powered background removal. Your use of these services is subject to their respective terms of service and privacy policies. SMRT is not responsible for the practices of any third-party service providers.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SMRT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMRT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO SMRT IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in [Your County], [Your State].

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the Effective Date above. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
